These Terms of Service (“Terms”) govern access to and use of the LuggagePodHire.com website, marketplace, applications, communications and related services (together, the “Platform”).
By accessing or using the Platform, creating an account, listing a luggage pod, requesting or confirming a booking, making a payment, or otherwise using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
These Terms apply to all users of the Platform, including Owners, Renters and visitors browsing the website.

- Definitions
In these Terms:
Booking means a reservation made through the Platform for the rental of a pod.
Owner means a user who lists a pod on the Platform.
Renter means a user who books or uses a pod through the Platform.
Pod means any rooftop luggage pod, roof box, cargo box, rooftop cargo carrier, roof-mounted storage container, bicycle rack, bike carrier, or any similar roof-mounted cargo or transport device or accessory made available for rental through the Platform, regardless of brand, design, material, mounting method, or terminology used in a Listing. For the purposes of these Terms, all references to a “Pod” include any such device or equipment listed or offered for hire on the Platform.
Listing means a page, advertisement, or offering published on the Platform by an Owner describing a pod available for rental, including but not limited to descriptions, photos, specifications, availability, pricing, pickup details, instructions, and any conditions or requirements stated by the Owner. For the purposes of these Terms, a Listing also includes any additional information, instructions, representations, or conditions communicated between the Owner and a Renter through the Platform’s messaging system in connection with a Booking. Information contained in a Listing, and any related instructions or representations provided through the Platform in connection with a Booking, form part of the rental information relied upon by Users when deciding whether to make or accept a Booking.
Stripe means Stripe or any replacement third-party payment provider used by the Platform.
User means any person who accesses or uses the Platform, including Owners and Renters.
Platform Content means all text, graphics, images, logos, software, design elements, user interfaces, and other material displayed on or forming part of the Platform, excluding content uploaded by Users.
Words used in the singular include the plural and vice versa.
Headings are for convenience only and do not affect interpretation of these Terms. ⸻
- About the Platform
LuggagePodHire.com (“we”, “us”, “our”) operates an online marketplace that enables Owners and Renters to connect for the hire of rooftop luggage pods.
The Platform may allow Users to: • create accounts • list pods • browse listings • message other users • request and accept bookings • pay rental charges and deposits • receive or process refunds • manage bookings and transaction history.

- Platform Policies
The following policies form part of these Terms of Service and apply to all use of the Platform: • Privacy Policy • Acceptable Use Policy • Safety & Installation Guide • any additional policies, rules or guidelines published on the Platform from time to time.
By accessing or using the Platform, creating an account, listing a pod, requesting or accepting a booking, or making a payment, you agree to comply with these policies.
If there is any inconsistency between these Terms of Service and another policy, these Terms of Service will prevail unless expressly stated otherwise.
We may update these policies from time to time and updated versions will be published on the Platform.
Continued use of the Platform after updates are published constitutes acceptance of those updated policies.

- Platform Role Only
LuggagePodHire.com is a technology platform and marketplace facilitator only.
We do not: • own pods • manufacture pods • supply pods • install pods • inspect pods • transport pods • supervise rentals • verify vehicle compatibility • guarantee user behaviour • guarantee the accuracy of listings • act as insurer, broker, agent, bailee, carrier or rental operator.
Unless expressly stated otherwise in writing, all pod rental arrangements are made directly between the Owner and the Renter.
Users acknowledge that the Platform is operated by LuggagePodHire Pty Ltd, and no individual director, employee, or representative of the company accepts personal liability for obligations of the Platform except where required by law.

- No Agency, Partnership or Employment
Nothing in these Terms creates any agency, partnership, joint venture, fiduciary, employment, franchise, or representative relationship between: • LuggagePodHire.com and any User, or • any Owner and any Renter,
except as independent contracting parties to a rental arrangement between themselves.
Users acknowledge that LuggagePodHire.com does not act on behalf of Owners or Renters and is not authorised to make promises, representations, warranties or commitments on behalf of any User.

- Not a Party to Rentals
When a Booking is confirmed through the Platform, the rental agreement is solely between the Owner and the Renter.
LuggagePodHire.com is not a party to that rental agreement and is not responsible for: • the condition, legality, safety or suitability of any pod • whether a pod matches a listing • whether a Renter is suitable, licensed, careful, honest or competent • whether an Owner is truthful, responsive or fair • whether the pod is properly installed • whether the pod is used lawfully or safely.

- No Verification Guarantee
LuggagePodHire.com may offer registration, account, payment, messaging or profile functionality, but does not verify the identity, driving ability, qualifications, reliability, background, creditworthiness, or suitability of Users beyond any basic platform registration process.
Users interact with each other entirely at their own risk.

- Eligibility
To use the Platform, you must: • be at least 18 years old • have the legal capacity to enter binding agreements • provide accurate and current information • comply with all applicable laws, regulations and road rules.
You must not use the Platform if you are prohibited from doing so by law.

- User Accounts
To list or rent a pod, you must create an account.
You agree to: • provide true, accurate and complete information • keep your information up to date • keep your username, password and login credentials secure • be responsible for all activity under your account.
You must notify us promptly if you suspect unauthorised access to your account.

- Electronic Acceptance
By confirming a Booking on the Platform, both the Owner and the Renter agree to the rental terms contained in these Terms.
Electronic acceptance, tick-box acceptance, account creation, booking confirmation, payment submission, and continued use of the Platform may all be relied on as evidence of agreement to these Terms.

- Rental Terms Between Owners and Renters
The following terms apply between Owners and Renters when a Booking is confirmed through the Platform.
11.1 Rental Period
The rental period begins at the pickup time and date shown in the Booking and ends at the return time and date shown in the Booking, unless otherwise agreed through the Platform.
11.2 Return Condition
The Renter must return the pod: • on time • with all supplied parts, fittings, keys and accessories • in substantially the same condition as received, excluding fair wear and tear.
11.3 Late Return
Late return may result in additional charges, compensation claims, deposit deductions, or other remedies agreed between the Owner and the Renter or permitted under these Terms.
11.4 Pickup and Return Logistics
Owners and Renters are solely responsible for coordinating pickup, return, location, timing, handover instructions, and any face-to-face arrangements.
11.5 Pod Condition at Handover
Owners and Renters should inspect the pod at pickup and return.
Both parties are strongly encouraged to take clear timestamped photos or video of the pod and any accessories immediately before pickup and immediately after return.
These records may assist in resolving disputes regarding condition, damage, or missing parts.
Where no condition records are provided, the Platform may be unable to assist in reviewing claims relating to equipment condition.

- Owner Responsibilities
Owners are solely responsible for: • the pod they list • the accuracy of their listing • the legality of offering the pod for hire • communicating relevant instructions and requirements • maintaining the pod • ensuring the pod is reasonably safe for normal use.
Owners must not list pods they know or reasonably should know are unsafe or defective.
Owners must ensure that any equipment listed on the Platform is reasonably safe for its intended purpose, maintained in usable condition, and supplied with the essential components required for normal installation and use. Owners must not list equipment they know, or reasonably should know, is unsafe, defective, unlawfully modified, or missing critical mounting hardware.

- Owner Safety Warranty
Each Owner represents and warrants that any pod listed by that Owner: • is owned by them or lawfully available for hire • is reasonably safe for normal road use when correctly installed • is free from known material defects not disclosed in the listing • includes the necessary mounting hardware • has been reasonably maintained.
The Owner accepts full responsibility for the safety, condition, and legality of equipment they list on the Platform.

- Renter Responsibilities
Renters are solely responsible for: • choosing a suitable pod • ensuring vehicle compatibility • safe installation • safe loading of cargo • obeying road laws • returning the pod in proper condition.
Users are responsible for obtaining and reviewing the manufacturer’s installation and usage instructions for any equipment used through the Platform. Where such instructions are not supplied with the equipment, the User must take reasonable steps to obtain them independently before installing or using the equipment.
Any guidance, comments, demonstrations, photos, or instructions provided by an Owner, a Renter, or through the Platform are provided for general informational purposes only. Users must independently verify safe installation and compatibility with their vehicle and equipment before use. LuggagePodHire.com does not supervise, inspect, approve, or certify the installation of any equipment.
Users must not rely solely on information provided by other Users when determining compatibility or installation safety.
If a pod becomes damaged, unstable, loose, or otherwise unsafe during the rental period, the Renter must stop using the equipment immediately and take reasonable steps to prevent further damage or risk, including contacting the Owner to arrange repair, return, or replacement where appropriate. Continued use of equipment that a Renter knows, or reasonably should know, is unsafe may constitute misuse of the equipment and may result in the Renter being responsible for any resulting damage, loss, or claims arising from that continued use.

- Installation Responsibility
The Renter is entirely responsible for installation of the pod unless the Owner independently agrees to assist.
The Renter must ensure: • compatible roof racks or crossbars are installed • mounting clamps and locks are secured • the pod is closed and locked before travel.
The Renter is solely responsible for ensuring that their vehicle is legally permitted to carry roof-mounted equipment and that the vehicle manufacturer’s roof load limits and any applicable rack system limits are not exceeded.
LuggagePodHire.com does not install or inspect pods. LuggagePodHire.com does not verify vehicle specifications, roof load ratings, rack compatibility, or the legal suitability of any vehicle for the installation of equipment rented through the Platform.

- Vehicle Compatibility and Load Limits
The Renter must ensure: • vehicle roof load limits are not exceeded • roof rack limits are not exceeded • pod load limits are not exceeded • cargo is safely distributed and secured.
The Renter must ensure that the vehicle, roof rack system and installed equipment are compatible and suitable for the intended use.
LuggagePodHire.com does not verify compatibility, load ratings, installation safety, or vehicle suitability.

- Driver Responsibility
The driver of a vehicle fitted with a pod is responsible for safe operation of the vehicle and compliance with all applicable road laws.
Drivers must adjust driving behaviour to account for the presence of roof-mounted equipment, including height clearance, vehicle handling, braking distance, and load stability.

- Acceptable Use of Pods
Renters must not: • modify the pod • exceed weight limits • transport hazardous materials • sublet the pod • use the pod recklessly • use the pod in a manner inconsistent with manufacturer instructions

- Safety Acknowledgement
Users acknowledge that rooftop equipment involves inherent risks including installation error, shifting loads, vehicle handling changes, road hazards, water ingress, theft, property damage, and personal injury.
Users voluntarily assume all risks associated with installation, loading, driving, and use of pods rented through the Platform.

- Deposits
Owners may require security deposits to cover: • damage • missing parts • excessive cleaning • late return.
Owners and Renters are encouraged to document the condition of the pod at pickup and return using photographs or video.

- Payments
Payments are processed through Stripe or other providers.
Users authorise Stripe and the Platform to charge, hold, and transfer funds related to bookings.

- Platform Fees
We may charge service or platform fees, disclosed during booking.

- Stripe Processing Fees
Stripe fees may apply and may not always be refundable.

- Refunds and Cancellations
Refund outcomes depend on booking status, timing, owner policies, Stripe behaviour, and damage claims.

- Transaction Reversals
Stripe may reverse transactions due to fraud, disputes, compliance reviews, or technical issues.

- Chargebacks
Users must attempt to resolve issues through the Platform before initiating chargebacks.
Accounts may be suspended for abusive disputes.

- Taxes and GST
Users are responsible for their own tax obligations.

- Damage, Loss and Theft
Renters must notify Owners of damage or loss promptly.

- No Mediation Obligation
LuggagePodHire.com is not obligated to adjudicate disputes between users.

- Insurance
LuggagePodHire.com does not provide insurance coverage.

- Third-Party Damage Disclaimer
To the maximum extent permitted by law, LuggagePodHire.com is not responsible for damage, injury, or loss to third parties arising from installation or use of pods.

- Consumer Law
Nothing in these Terms excludes rights under the Australian Consumer Law.

- Platform Disclaimers
The Platform is provided “as is”.

- Limitation of Liability
Our liability is limited to platform fees paid in the preceding 12 months.

Users release LuggagePodHire.com from claims arising from interactions between users.

Users indemnify the Platform against claims arising from misuse or breach of these Terms.

- Listings and User Content
Users grant us a licence to use listing content for operating and promoting the Platform.

- Misleading Statements
Users must not provide misleading or deceptive information.

- Prohibited Conduct
Users must not engage in fraud, harassment, or illegal activity.
Users must not create false identities, impersonate another person, or provide misleading information when using the Platform. We may request verification information where reasonably necessary to protect the Platform or other Users.

- Suspension
We may suspend accounts for policy breaches or fraud risk.

- Off-Platform Transactions
Users must not use the Platform to identify, contact, or communicate with another User for the purpose of completing a booking, payment, rental, or related transaction outside the Platform in order to avoid Platform fees, platform protections, or record-keeping.
This restriction applies to any attempt to move a transaction off the Platform after Users have connected through the Platform, including through direct messaging, phone numbers, email addresses, social media, external websites, or in-person arrangements.
All bookings originating through the Platform must be completed and paid for through the Platform unless expressly authorised by LuggagePodHire.com in writing.
If we reasonably believe that Users are attempting to circumvent the Platform, we may:
• suspend or terminate accounts • cancel bookings • remove listings • withhold payouts • recover unpaid platform fees • charge reasonable administrative costs arising from the circumvention.

- Platform Availability
We do not guarantee uninterrupted, secure or error-free operation of the Platform.
